So if this is true that Viacom did not take this down, which at this point I am inclined to agree (considering this was sent to me directly from youtube themselves and should not have been altered by them to protect Viacom, then youtube is to blame for allowing DMCA claims to be made by unverified sources and acting on them as if they were fact. MAKE A VIDEO RESPONSE I want everyone that has ever had a video unjustly taken down or have had a channel banned from youtube to make a video stating their case. This is your chance to tell your story. Some videos and channels were removed correctly for copyright infringement, this video is not about those legitimate copyright claims. This is for the videos and channels that were unjustly banned from youtube. State your case. Share your story. I am looking to feature at least one video that will be posted as a video response in one of my future videos. Make sure you have as many facts as you can regarding your video. The more details the better. I am doing this video because most people have no idea how many people have videos removed or were flat out kicked off of youtube for what could be a unjust copyright claim. While I have always agreed that their property should be protected and should be removed if they needed it to be. This time they crossed the line. Actually they have done this many times before. They do this because they are a large corporation and think they can get away with it. For the most part they have. Recently some trigger happy person at Viacom took down the video Viacom vs you from youtube. It was obvious to everyone that there was absolutely no copyright issue with that video whatsoever. Yet it was still removed. Most videos that are taken down unjustly never see the light of day again. I am only back up now because of all the support from my viewers. This is not just a Viacom problem, it is also a youtube problem. Anyone can accuse any channel anytime for copyright infringement. It is up to the accused to prove their innocence rather then the accusor. From what I have seen there are no severe penalties for a false copyright claim made by a channel or a business. Channels and businesses that make more then one false copyright claim need to be punished severely for their actions. This is a very serious subject on youtube and around the net. This has happened multiple times to many different channels. There is also no distinction between a copyright infringing video and a video dealing with fair use. TRADE MARK / COPYRIGHT INFO: Trademarks and "service marks" — are governed in the U.S. by the federal Lanham Act, along with various different laws in the individual states. The basic purpose of trademark law is to protect consumers by enabling them to rely on recognizable marks to identify the source of goods and services. It follows that unless there is a likelihood that the unauthorized use of a trademark or service mark will confuse consumers, there is no violation of trademark law. In many cases, courts don't need to address fair use or other possible defenses because there is no real likelihood of confusion. But trademark rights are closely related to a number of other rights, and trademark owners will also frequently make claims about "dilution", "passing off", "unfair competition", or the "right of publicity". "Trademark dilution" lets owner of a "famous" mark stop any use that blurs or tarnishes its distinctiveness ( Not Reputation) — even if there is no chance that consumers will be confused. Because the concept of dilution has such potentially broad reach, there are specific defenses in the federal Lanham Act that are applicable to claims of dilution. "All forms of news reporting and news commentary" are exempted, as are comparative advertising, and "noncommercial use". The First Amendment and state constitutional protections for speech provide additional protections for news reporting and commentary. While I do state certain legal items in my videos and in my text it is up to you to do your own research. I am here to shed some light on a pretty dark subject, but by no way am I responsible for any conclusions you draw from my videos or my information. If you are going to act against someone for anything dealing with a copyright lawsuit. Hire your own attorney and go over your claim in detail with them. The information I provide is to give people an idea of the laws, but not to be the only source on them. This subject is not over. Until youtube provides me with the proper documentation, we will not be 100% certain that Viacom did this, but all signs to point to them. FALSE COPYRIGHT CLAIM BY YOU KNOW WHO! IMPORTANT!!! DOWNLOAD AND SAVE MY VIDEOS ! My channel has been targeted to be deleted from youtube. It could happen any day now. Viacom is not the only problem here. Youtube could have dismissed the claim, but they did not. They just accommodate them to no end here on youtube and they never lift a finger to even check to see if the claim is legitimate. Youtube doesn't give a damn about the users here. There was nothing in the video but a couple of images and me talking. Nothing from any TV show, any movie, not even a second of a song. Nothing. Yet viacom went after that video. You can see the original video on my myspace page. I just uploaded it there for you to see for yourself. I didn't think they would do something this blatant, but they never cease to amaze me in their public relations debacle. I don't think they can handle this any worse. I will never buy another product that Viacom ever produces again after this latest action. When asked by another youtuber why they buried this subject they sent the following answer: "Story was reported (General, 1-click bury) and subsequently removed by the Digg community." From what I gather this means that literally one person was able to completely remove this story and video from digg.com to where you could only find it on my digg page or through a direct link. I could not believe that this kind of thing was even possible on their site. I am making this video to let you know what happened to the story and how they handled it on their site. Needless to say I was not happy to see that a website that I was promoting and supporting was going to treat my content like that. So for the last time please digg this story to help try to get a satisfactory answer to how this happened on a site that was supposed to be about the people deciding on what stories are popular and which are not. Not just one person randomly deciding to totally bury a story that clearly many people were supporting. Google must divulge the viewing habits of every user who has ever watched any video on YouTube, a US court has ruled. The ruling comes as part of Google's legal battle with Viacom over allegations of copyright infringement. Digital rights group the Electronic Frontier Foundation (EFF) called the ruling a "set-back to privacy rights". The viewing log, which will be handed to Viacom, contains the log-in ID of users, the computer IP address (online identifier) and video clip details. While the legal battle between the two firms is being contested in the US, it is thought the ruling will apply to YouTube users and their viewing habits everywhere. Viacom, which owns MTV and Paramount Pictures, has alleged that YouTube is guilty of massive copyright infringement. The UK's Premier League association is also seeking class action status with Viacom on the issue, alleging YouTube, which was bought by Google in 2006, has been used to watch football highlights. Legal action When it initiated legal action in March 2007 Viacom said it had identified about 160,000 unauthorised clips of its programmes on the website, which had been viewed more than 1.5 billion times. Following the launch of its billion-dollar lawsuit, YouTube introduced filtering tools in an effort to prevent copyright materials from appearing on the site. The US court declined Viacom's request that Google be forced to hand over the source code of YouTube, saying it was a "trade secret" that should not be disclosed. But it said privacy concerns expressed by Google about handing over the log were "speculative". Google's senior litigation counsel Catherine Lacavera said in a statement: "We are disappointed the court granted Viacom's over-reaching demand for viewing history. "We will ask Viacom to respect users' privacy and allow us to anonymise the logs before producing them under the court's order." The ruling will see the viewing habits of millions of YouTube users given to Viacom, totalling more than 12 terabytes of data. Viacom said it wanted the data to "compare the attractiveness of allegedly infringing video with that of non-infringing videos." YouTube and Google had "compelled" it to go to court, Viacom said, "by continuing to defend their illegal and irresponsible conduct and profiting from copyright infringement, when they could be implementing the safe and legal user generated content experience they promise". It said it would not be asking for any "personally identifiable information" of any user. SEX ON YOUTUBE Most of the people I know don't even look at the most viewed page on youtube anymore and just click on the top rated because most of the most viewed videos tend to be videos that use misleading thumbnails of women to gain views that they otherwise would never get. Please digg this if you like it by clicking on the link below: http://digg.com/programming/SEX_ON_YOUTUBE_3 Since youtube has found a way to let you view partners only (excluding the channels that make videos and never get a dime for making them) on youtubes most viewed page, maybe they can filter out some of the adult style content as well. While some of the videos that are adult themed are not just lame soft core porn and are helpful information for people looking for it, it would still be nice to be able to click on a setting that would allow youtube to filter adult videos out if you don't want them on your searches or when you are looking at the most viewed videos of the day. Sure there are more pressing things in the world, but sometimes these videos and titles get really annoying and most people don't seem to like them because almost half the time they have a rating of 2 stars or lower. That is pretty direct negative feedback of how the people feel about the videos that I am referring to. So I cant be totally alone in feeling this way. I just wanted to make a video to see if other people agree that it would be nice to be able to filter them out. Let me know what you think. I do not make videos for ego purposes, I do not make them to become a youtube partner. I only make these videos to try to inform people of how I see things right now and the only reason why I am asking this of you, is so that when I discuss things like the war, racism, health care, politics etc... Many people can openly discuss the subject of the video and see a view that they may not have heard before or find out that their view is not as different as they may think. You may NOT be in the minority on some of these subjects. I want to discuss subject matter that I feel is important and the only way to get a broad discussion started is with your help and support. Unfortunately, if a video doesn't get some visibility in the first 24 hours, you might as well have never uploaded it. I have noticed that for most videos that 70% to 80% of the total views come within the first 24 to 48 hours. After that they are lost in the shuffle of billions of other articles and videos. So it is imperative that if you want to help support a particular video I upload, please remember to rate comment and digg in the first 12 hours if possible. If you dont have a digg account yet, it takes only a minute or two to set up an account. If this channel were to ever get large enough to make these lists automatically, I would love to stop asking for the support of the people watching it, but in reality a channel discussing topics like this will not be easily found. I am speaking about very unpopular subjects right now and I wish things were not this way so I could make videos about subjects that are a lot more fun, but right now I just cant.
